In addition to the Sony Ericsson Legal Notice, including User Terms and Privacy Notice available at www.sonyericsson.com/Legal, the following "Terms of Service" to apply to the TrackID™ website, http://trackid.info, (“TrackID™ Website”) and the TrackID™ application, a digital application that facilitates the use of a central audio music recognition service that provides songs and artist identification (TrackID™ Application), supplied by Sony Ericsson Mobile Communications AB, Nya Vattentornet, 221 88 Lund, Sweden, and its “Affiliates”, ("we", "us" and "our" as appropriate), (together referred to herein as “TrackID™”), and other related third party applications and websites in conjunction with the TrackID™ Application and/or associated services (for example, e-commerce providers, social networking sites, information and access feature providers).

Our specific services include music recognition, related applications and music downloading services. These services are available via your device or by accessing our TrackID™ Website. TrackID™ Application is a mobile phone application, which enables you to track music and use related services available within the application. Each time you attempt to recognise music using TrackID™ you will send data, which your network operator may charge at your usual data rates. You may purchase music downloads via the TrackID™ Application or any TrackID™ Website as they are made available by us. Cost for using the TrackID™ may vary from country to country. You are responsible for any costs or expenses incurred as a result of use of TrackID™ (including without limitation operator network and roaming charges). Check with your local service provider for current charges. Price and specific payment terms will be made available to you at the time of purchase. You are fully responsible to get yourself informed before the purchase regarding whether such downloads are relevant or appropriate for you. Due to the nature of the service we are not able to cancel your purchase of the download once we begin the process of delivering your download.


TrackID™ may enable you to use functionalities of third party applications and/ or to link to third party sites that are not owned or controlled by us. Content, products and services that are part of any third party applications and/or sites to which we may connect or link (including but not limited to, social networking sites, sites on which you can view content and from which you can make purchases, or record a geographic location that you find yourself in) are subject to the terms and conditions of the relevant application and/ or website. We have no control over and are not responsible or liable for any matters relating to your dealings with such third parties and over any third-party content, syndicated content, applications, services, advertisements, links, privacy policies and/ or practices of any such third-parties that may be found through TrackID™. We encourage you to check the privacy policies of all third party sites that you visit.


You may purchase downloads for your personal and non-commercial use only. You are granted a limited, revocable, non-exclusive licence to display content as part of the services solely for your personal use. You may not copy, lend, hire, make available, modify, translate, reproduce, distribute, publish, broadcast, perform, display, sell, assign, lease or sub-license that content, in whole or in part. You agree not to disassemble, de-compile, reverse engineer, or otherwise attempt to gain access to the source code of TrackID™ or services or any third party application. You will not copy any part of TrackID™ or any third party applications and/or sites or make commercial use of, rent, lease, loan, sell, publish, license, sublicense, distribute, assign or otherwise transfer any part of TrackID™ to any person.


You are responsible for the information you provide to Sony Ericsson and for any consequences thereof. You agree that you will use the TrackID™ website and any related software in compliance with all laws and regulations, including any laws regarding the transmission of technical data exported from your country of residence and all United States export control laws. You will not and will not allow any third party to: (i) use the TrackID™ or any related software to upload, transmit or otherwise distribute any content that is misleading, unlawful, defamatory, harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable; (ii) upload, transmit or otherwise distribute content that infringes upon another party's intellectual property rights or other proprietary rights; or, (iii) use TrackID™ for any fraudulent or inappropriate purpose.


As a condition to use TrackID™ and, if applicable, the related software, you agree to the terms of Sony Ericsson User Terms and Privacy Notice at www.sonyericsson.com/Legal, You agree that Sony Ericsson may access or disclose your personal information, including the content of your communications, if Sony Ericsson is required to do so in order to comply with any valid legal process, or as otherwise provided in these Terms of Service and the Sony Ericsson Privacy Notice. Personal information collected by Sony Ericsson may be stored and processed in the United States or any other country in which Sony Ericsson Mobile Communications AB, its affiliates, contractors or its agents maintain facilities. By using TrackID™, you consent to any such transfer of information outside of your country.


We may, without any liability to you, modify, suspend or discontinue these Terms of Service without notice at any time. You agree to be bound by any modifications. If you do not accept and abide by this Terms of Service, you may not use the TrackID™ Website or download or use any related software. YOUR CONTINUED USE OF TrackID™ NOW, OR FOLLOWING THE POSTING OF NOTICE OF ANY CHANGES IN THESE TERMS, WILL BE DEEMED ACCEPTANCE BY YOU OF THESE TERMS AND ANY SUCH CHANGES, OR MODIFICATIONS. YOUR USE OF TrackID™ IS AT YOUR SOLE RISK. THE TrackID™ IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTY THAT, AND DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR, THE AVAILABILITY, TIMELINESS, SECURITY, RELIABILITY, QUALITY OF TrackID™, ANY RELATED SOFTWARE OR APPLICATION, ANY THIRD PARTY WEBSITE (AS LINKED OR OTHERWISE ASSOCIATED), OR OTHER PRODUCTS, SERVICES, INFORMATION PURCHASED OR OBTAINED THROUGH TrackID™. WE HAVE NO RESPONSIBILITY OR LIABILITY FOR THE DELETION OF, OR THE FAILURE TO STORE OR TO TRANSMIT, ANY CONTENT AND OTHER INFORMATION MAINTAINED OR TRANSMITTED BY TrackID™. WE ARE NOT RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY INFORMATION OR ADVICE TRANSMITTED THROUGH TrackID™. WE MAY, AT ANY TIME, LIMIT USE AT ITS SOLE DISCRETION. WE TAKE NO RESPONISBILITY FOR THIRD PARTY CONTENT.


You acknowledge that we own all right, title and interest in and to TrackID™ and to the related software. TrackID™ and any content provided by us as part of TrackID™, including but not limited to artist information and downloads contains patents, copyrighted material, trademarks and other proprietary rights, belonging to us and our licensors. All right, title and interest in and to such content vests in us and our licensors. You will not alter, destroy, obscure, or otherwise remove any copyright or proprietary notices or labels on or embedded within any part of TrackID™ and/or any third party applications. TrackID™ is powered by Gracenote™ Mobile MusicID™. Gracenote and Gracenote Mobile MusicID™ are trademarks or registered trademarks of Gracenote, Inc. TrackID™ and the Sony Ericsson logo is the trademark or registered trademark of Sony Ericsson Mobile Communications AB. Sony is the trademark or registered trademark of Sony Corporation. Ericsson is the trademark or registered trademark of Telefonaktiebolaget LM Ericsson.


These Terms of Service are governed by the laws of Sweden, excluding its conflict of laws provisions. You further consent to the jurisdiction of the Swedish courts.
